    Vaillant Saunier Duval, S.A.U (en adelante, “Saunier Duval”), con NIF número A-48.037.295, domicilio social en Zamudio (Bizkaia), PI Ugaldeguren III, parcela 22, cuyos datos de contacto se encuentran publicados en saunierduval.es, inscrita en el Registro Mercantil de Bizkaia, Hoja BI-3911; Tomo 5523; Folio 29, organiza la promoción INCONFORMISTA (en adelante, la “Promoción”) con el fin de promocionar los productos de la marca Saunier Duval, conforme a las presentes condiciones.

    2. ÁMBITO TERRITORIAL Y PERIODO DE VIGENCIA

     

    La Promoción se desarrollará en el territorio de España, (en adelante, el “Ámbito Territorial”) en las fechas comprendidas entre el día 2 de octubre y el 30 de noviembre de 2023 (en adelante el “Periodo de Vigencia”). No obstante, la Promoción podrá terminar de forma anticipada cuando se agoten los Premios descritos en el apartado “PREMIO. DESCUENTOS O BENEFICIOS”. El Interesado puede consultar si la Promoción se encuentra o no en vigor en saunierduval.es/inconformista.

    3. NATURALEZA DE LA PROMOCIÓN

     

    La Promoción consistirá en la entrega gratuita de descuentos comerciales o beneficios a usuarios finales que adquieran productos Saunier Duval, en los términos previstos en estas condiciones. La Promoción no será acumulable con otras ofertas o promociones.

    4. DESTINATARIOS DE LA PROMOCIÓN

     

    Podrán participar en la Promoción todas aquellas personas físicas y jurídicas que tengan interés en adquirir un equipo de climatización Saunier Duval para su uso propio (en adelante, los “Interesados”) y cumplan con los requisitos y condiciones establecidos en el apartado “PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN”. La edad mínima de participación en la Promoción será de 18 años.

    5. PREMIO. DESCUENTOS O BENEFICIOS

     

    Los Interesados en la Promoción recibirán hasta 250 Euros (en adelante, el “Premio” o “Premios”) por la compra de productos de la marca Saunier Duval, en los términos previstos en el apartado “PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN”. Cada Interesado únicamente tendrá derecho a percibir un Premio por inmueble, con independencia del número de productos que adquiera.

    La descripción, contenido y cuantía de los Premios está detallada en el Anexo de estas condiciones.

    La Promoción incluye un número total de 4.900 Premios por lo que en el momento en que se agoten finalizará la Promoción. El Interesado puede consultar si la Promoción se encuentra o no en vigor en saunierduval.es/inconformista. A estos efectos se entenderá que los Premios se agotarán en el momento en que se hayan producido 4.900 solicitudes conforme al procedimiento previsto en el apartado “6.- PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN”.

    El Premio o el derecho a su obtención es intransferible y queda prohibida su comercialización y/o venta a terceros.

    En caso de tratarse de Premios en especie, se aplicarán las siguientes condiciones específicas:

    i. el contenido de los Premios se limita a los conceptos expresamente especificados en estas condiciones por lo que queda excluido cualquier otro concepto accesorio o adicional;

    ii. los Premios en ningún caso podrán ser canjeados por dinero.

    iii. cualquier pretendido derecho de garantía sobre los Premios en especie deberá reclamarse a la empresa fabricante o proveedora de los mismos.

    iv. Cuando proceda, el Interesado deberá aceptar los términos y condiciones de uso establecidos por el proveedor del Premio. En particular el Interesado deberá disfrutar el Premio dentro del plazo establecido por el Proveedor.

    v. En caso de fuerza mayor o fin de existencias Saunier Duval se reserva la posibilidad de sustituir los Premios descritos por otros de igual o superior coste.

    6. PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN

    Para que los Interesados puedan beneficiarse de la Promoción a través de este procedimiento deberán cumplirse las condiciones que se indican a continuación, todas ellas cumulativas:

    • El Interesado debe comprar e instalar uno o más de los productos Saunier Duval que se indican en el Anexo.
      La compra e instalación deberán realizarse durante el Periodo de Vigencia y dentro del Ámbito Territorial.
      Se excluyen de la Promoción los productos vendidos en obra nueva, o con descuentos especiales, así como los modelos Semia 25 e Isotwin MiConnect®.
    • El Interesado debe solicitar el Premio dentro del Periodo de Vigencia a través del formulario publicado en saunierduval.es/inconformista o a través del número de teléfono 910 77 10 50. El Interesado que cumpla este requisito recibirá un email de confirmación que deberá conservar a efectos de acreditar su participación en la Promoción.
    • El Interesado debe realizar la intervención de puesta en marcha de su nuevo equipo 2 de octubre y el 31 de diciembre de 2023. Esta intervención es de carácter obligatorio en virtud del Real Decreto 1027/2007 (RITE) y el Interesado podrá realizarla de forma gratuita a través del Servicio de Asistencia Técnica Oficial de Saunier Duval. Saunier Duval no garantiza la realización de la puesta en marcha en plazo cuando esta se solicite fuera del Periodo de Vigencia.
      Asimismo, el Interesado podrá solicitar esta intervención a cualquier otra empresa que esté homologada por la administración competente como agente de puesta en marcha, en cuyo caso deberá atenerse a las condiciones comerciales ofertadas por la empresa seleccionada. En este caso el Interesado deberá enviar el justificante de la realización de la puesta en marcha a info@saunierduval.es, antes del día 31 de diciembre de 2023.

    Quienes cumplan la totalidad de condiciones de participación tendrán derecho a los Premios, salvo que se estén beneficiando de otra oferta o promoción por la compra del mismo producto.

    Saunier Duval podrá requerir a los Interesados que acrediten el cumplimiento de las condiciones de participación en cualquier momento previo a la entrega de los Premios. En particular, cuando existan dudas razonables sobre el cumplimiento de las condiciones de participación Saunier Duval podrá requerir a los usuarios una copia de la factura correspondiente a la compra e instalación de su equipo. En estos casos Saunier Duval solicitará al Interesado que borre o tache de la factura los datos relativos a las condiciones económicas de la venta, incluyendo el precio.

    Los Interesados serán excluidos de la Promoción y, por tanto, perderán su derecho a la obtención de los Premios, de forma automática, cuando i) incumplan alguna de las normas u obligaciones previstas en estas condiciones, o de alguna forma participen en cualquier comportamiento desleal, o que impida el normal desarrollo de la Promoción o ii) soliciten la cancelación de sus datos personales o se oponga al tratamiento de los mismos que sea necesario para la gestión del Promoción.

    7. ENTREGA DE PREMIOS

     

    La entrega de los Premios se realizará mediante transferencia bancaria al número de cuenta que facilite el usuario al efecto, en el plazo máximo de 60 días a contar desde la fecha en que se acredite el cumplimiento de las condiciones de participación. El plazo máximo indicado podrá incrementarse hasta el día de pagos de la empresa más próximo (días 11 y 26 de cada mes).

    8. FISCALIDAD

     

    Saunier Duval aplicará la legislación vigente relativa a impuestos y tasas que corresponda en relación a los Premios del presente descuento comercial.

    9. EXENCIÓN DE RESPONSABILIDAD

     

    Saunier Duval queda eximida de cualquier responsabilidad por los eventuales daños y perjuicios que se pudieran producir a los Interesados o a terceros ajenos a esta Promoción, cuando estos fueran consecuencia directa o indirecta de alguna de las circunstancias que se describen a continuación:

    • El uso que hagan del Premio los Interesados agraciados.
    • Defectos de fabricación o calidad en los productos incluidos en los Premios.
    • Errores en los datos facilitados por los participantes en algún momento del proceso de la Promoción.
    • Falta de disponibilidad o de continuidad de los servicios necesarios para el buen funcionamiento de la Promoción.
    • Fallos en el acceso a las distintas páginas web y en las comunicaciones a través de Internet.
    • Retrasos, pérdidas o deterioros por causas que no le sean directamente imputables a Saunier Duval.
    • Casos de fuerza mayor.

    Cualquier otra incidencia o reclamación sobre esta Promoción deberá realizarse mediante escrito dirigido a Saunier Duval, en el plazo máximo de tres (3) meses a contar desde la finalización del Periodo de Vigencia.

    En el caso de que la Promoción se articule a través de redes sociales (Facebook, Instagram, Twitter …), se deja expresa constancia de que el mismo no está patrocinado, avalado, administrado ni asociada de modo alguno a la red social.

    10. PROTECCIÓN DE DATOS PERSONALES

    Saunier Duval utilizará los datos personales que le haya facilitado cada Interesado en el marco de esta Promoción. A modo de ejemplo, se indica a continuación un listado no exhaustivo de los datos que pueden ser objeto de tratamiento: nombre, apellidos, DNI, dirección postal, teléfono, correo electrónico, datos bancarios, clave o contraseña de los Interesados.

    Saunier Duval tratará los datos del usuario con la finalidad principal de gestionar la Promoción. Esta finalidad incluirá la totalidad de tratamientos que resulten necesarios para la correcta ejecución del contrato incluyendo, entre otros, los siguientes:

    i. utilización de datos para la comunicación de la existencia de la Promoción a los interesados

    ii. recogida, registro y uso de datos para la gestión de la Promoción;

    iii. cesión de datos al proveedor responsable de los beneficios asociados a la promoción; o

    iv. conservación de datos durante el periodo legalmente obligatorio.

    Este tratamiento se lleva a cabo sobre la base legal contemplada en el apartado b) del artículo 6.1 del Reglamento (UE) 2016/679, a saber: la ejecución de un contrato. El contrato que justifica este tratamiento es la participación en la Promoción. Este tratamiento es condición necesaria para poder participar en la Promoción.

    Como norma general Saunier Duval no cederá los datos del usuario a terceros, salvo obligación legal. Saunier Duval podrá contratar terceras empresas que traten los datos del usuario con las finalidades descritas en este documento, en condición de encargadas del tratamiento. Estas empresas podrán ser, entre otras, las pertenecientes al mismo grupo empresarial que Saunier Duval (información detallada en www.saunierduval.es ) y los proveedores responsables de los beneficios asociados a la Promoción.

    En virtud de la normativa vigente el interesado tiene derecho a acceder a los datos tratados por Saunier Duval que se refieran a su persona, así como a solicitar su modificación y/o supresión. Asimismo, el interesado podrá oponerse o retirar su consentimiento para el envío de información comercial en cualquier momento. El usuario puede solicitar el ejercicio de cualquiera de sus derechos a través del formulario publicado en www.saunierduval.es/para-el-usuario/baja o mediante comunicación escrita dirigida a la dirección de Saunier Duval (PI Ugaldeguren III, parcela 22, 48170, Zamudio Bizkaia), junto con una copia del documento que acredite su identidad.

    11. ACEPTACIÓN Y DEPÓSITO DE LAS CONDICIONES

     

    La simple participación en la Promoción supone la aceptación de estas condiciones.

    Saunier Duval se reserva el derecho a aplazar o ampliar el periodo de la Promoción, así como la facultad de interpretar estas condiciones. Asimismo, Saunier Duval podrá acortar, prorrogar, modificar o cancelar la Promoción cuando concurran circunstancias excepcionales que justifiquen tales medidas, comprometiéndose, en su caso, a notificar a los participantes las nuevas condiciones, o la cancelación de la Promoción, en un plazo razonable.
